Rules and Conditions (United Way)
1. No donation or purchase is necessary to enter or win. A purchase or donation will not increase your chances of winning.
2. ELIGIBILITY: Story Search is open to all individuals who are at least 18 years of age or older as of June 21, 2009. Employees of United Way of America (UWA) and its subsidiaries (not including local United Way organizations) agents, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter.
Top US story submissions will be considered for the US national advertising campaign. Other story submissions may be featured in other promotional opportunities. Void where prohibited by law and subject to all applicable federal, state and local laws and regulations.
3. UWA reserves the right in its sole discretion to select any or no winners. UWA’s decisions are final and binding on all matters relating to this Story Search.
4. General Conditions: By participating, each entrant agrees:
(a) to abide by these Rules and decisions of UWA which shall be final and binding in all respects relating to this Story Search
(b) to release, discharge and hold harmless UWA and its respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively “Released Parties”) from any and all injuries, liability, losses, and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participatio in the Story Search or any Story Search related activity(c) to the use of his/her name, voice, performance, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by UWA and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so; and (d) each entrant warrants that (s)he is eligible to enter the Story Search. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Story Search without the prior consent of UWA which it may withhold in its sole discretion.
5. Ownership/Use of Entries: By submitting an entry. entrant
represents that (a) (s)he has the unrestricted right to submit
the entry and (b) the entry does not infringe upon any third
party’s proprietary or other rights. By entering the Story
Search each entrant unconditionally and irrevocably assigns and
transfers to Sponsor any and all rights which (s)he now has or
may in the future have in and to the Entry including, without
limitation, the copyright therein, in any medium whatsoever
(including all reproduction and other rights embodied therein
and relating thereto) and that it and its designees shall have
the unrestricted perpetual right to exploit, edit, modify, use
and distribute the entry and all elements of such entry,
including, without limitation, the names of any persons or
locations, embodied therein, in any and all media now known or
hereafter devised, worldwide, in perpetuity without
compensation, permission or notification to entrant or any third
party.
6. General Conditions: UWA reserves the right to cancel, suspend
and/or modify the Story Search, or any part of it, if any fraud,
technical failures or any other factor impairs the integrity or
proper functioning of the Story Search or for any reason the
Story Search is not operating or running as intended, in all
cases, as determined by UWA in its sole discretion. UWA, in its
sole discretion, reserves the right to disqualify any individual
it finds to be tampering with the entry process or the operation
of the Story Search or to be acting in violation of these Rules
and Conditions or those of any other promotion or in an
unsportsmanlike or disruptive manner. UWA’s failure to
enforce any term of these Official Rules shall not constitute a
waiver of that or any other provision.
Rules and Conditions (MEMELABS)
Contest Rules (basic)
Your participation in the Contest, including your submission of a Video to Memelabs.com shall be deemed to be your complete acceptance of the terms and conditions set out below by Memelabs.com (hereinafter referred to as Organizer) and The United Way(hereinafter referred to as Sponsor).
CHILDREN AND MINORS: Consistent with the Federal Children's Online Privacy Protection Act of1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent. Additional information can be found on the U.S. Federal
Trade Commission website. Any entrant who is a minor in his/her jurisdiction of legal residence will be required to obtain the permission of his/her parent or legal guardian to participate in this Contest. Entrant must also have obtained all necessary permissions from anyone else featured in his/her Submission,
including permission from parents or legal guardians of minors included in such Submission (written proof of such permission must be made available to Sponsor upon request).
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY.
PARTICIPATION CONSTITUTES ACCEPTANCE OF RULES AND DECISIONS, CONSENT TO USE AND RELEASE OF CLAIMS. By entering this contest, each participant warrants that he or she has read and agrees to abide by all contest rules and that he or she is not prohibited from participating in the contest. Participation in this contest constitutes participant’s full and unconditional acceptance of these Official Rules and the decisions of The United Way, its parents, affiliates, employees and agents, which are final, binding and non-negotiable in all respect. Each participant agrees to release, discharge, indemnify and hold harmless United Way and its parents, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the contest, including without limitation: (a) unauthorized human intervention in the contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (d) personal injury, death, and property damage; and (e) claims based on publicity rights, defamation, or invasion of privacy. Further, participants fully and unconditionally release all claims for consideration, copyright infringement and all other claims of any nature relating to the use of their entry, name or likeness.
ELIGIBILITY: Story Search is open to all individuals who are
at least 18 years of age or older as of June 21, 2009. Residents and Void where prohibited or restricted by law. Employees, contingent staff persons, officers and directors, together with members of their immediate families (parents, children, siblings and spouses of each) and/or those living in the same households, of Sponsor or Host, and their respective parents, subsidiaries and affiliates are ineligible to participate in the Contest or win any Contest prize.
Your participation in the Contest, including your submission of a Video to Memelabs.com shall be deemed to be your complete acceptance of the terms and conditions set out below by Memelabs.com (hereinafter referred to as Organizer) and Unite Way (hereinafter referred to as Sponsor).
1. All entries must be received by Sept 30 2009
2. Videos can be shot with camera phones, digital Video cameras or any other digital moving image format. No video entries will be accepted.
3. There is no cost or purchase required to enter this Contest.
4. Entry to the Contest is only open to persons of at least 18 years of age or older as of June 20 2009.
6. Employees and relatives of employees of Sponsor and Organizer and any entities affiliated or related to Sponsor and Organizer are not eligible to enter the Contest. For this purpose, the term "relative" shall mean spouse, partner, parent, child or sibling.
7. By submitting your contribution to the Organizer in relation to the Contest you agree to and thereby waive any and all moral rights that exist in your contribution to the Contest and any derivate works made
there from.
8. By submitting your contribution to the Organizer in relation to the Contest you represent, warrant and undertake to Sponsor and Organizer that your contribution (i) is your own original work and that you have the sole right to submit it to the Contest (ii) does not violate in any way rights of third parties including
copyright and other intellectual property rights and (iii) does not violate any applicable laws.
9. In the event that you breach any of your representations, warranties or undertakings contained herein Sponsor and Organizer shall be entitled to and may seek indemnification from you for recovery of all legal fees, damages, claims and other expenses that may be incurred by Sponsor or its affiliated entities as a
result of your aforementioned breach.
10. Your contribution to the Contest should not include any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, unlawful or otherwise objectionable.
11. Sponsor and Organizer reserve the right to alter or modify your contribution to the Contest without notification or consent from you.
12. Sponsor and Organizer reserve the right to change these terms and conditions at any time and at its sole discretion.
13. Entrants agree to grant to Sponsor and Organizer an everlasting, royalty-free, assignable, exclusive license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, play, sublicense and exercise all copyright and other intellectual property rights with respect to your contribution worldwide and/or to include your contribution in other works in any media now known or later created forever. Each entrant agrees and grants Sponsor and Organizer permission to make available and display/perform and otherwise distribute entrant's name and Video submission in all media in perpetuity without compensation. Except where legally prohibited, submission of an entry into this Contest constitutes permission for Sponsor and Organizer to use the entrant's name, videograph, likeness, voice, address (city and province/state) and testimonials, in printed, broadcast media or new media, in perpetuity, in any manner they deem appropriate in connection with promoting the Video submission itself or this Contest, without further compensation in connection with this Contest or the prize awarded.
14. Each entrant agrees to indemnify Sponsor from any third party claims arising from or related to that entrant's participation in the Contest. By participating, entrants agree that Sponsor, Organizer involved in the development, production, implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify
Organizer and Sponsor from any and all such claims, including the attorneys' fees related thereto. Organizer and Sponsor shall not be responsible for any technical malfunctions of the telephone network, computer on- line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury.
15. Entrants participating in this Contest are liable for any copyright infringements caused by their Videos.
16. Entrant is responsible to secure permission from all talent included in the Video. Sponsor and Organizer assume no responsibility for royalties or fees associated with talent performances in the entered Videos.
17. Sponsor and Organizer assume no responsibility for lost or late entries or for incomplete computer transmissions or technical failures.
18. Sponsor and Organizer reserve the right not to accept entries that are considered inappropriate for the Contest.
Notification
• The winners will be contacted at the phone and/or e-mail provided during registration.
• The winners and title of their entry will be announced on the Web site.
• The winning Videos will be featured on the contest website.
• Prizes will be delivered shortly after the winning Videos are announced. Video Creation Requirements

IDENTIFICATION OF POTENTIAL WINNER. United Way will notify the winner by first class mail, email, and/or telephone on or around TBD at the information provided on the entry form. Xxx is not responsible for lost, stolen, late, or misdirected mail. If unable to make contact with the winner within ten (10) days after xxx’s first attempts to notify the winner, or if the winner fails to claim the prize in accordance with these Official Rules, United Way will award the prize to the alternate winner. The winner must claim the prize by signing and returning the Authorization and Release form provided by United Way, a copy of these contest rules, and a completed W-9 form no later than TBD. In addition, the winner will cooperate with United Way to get all necessary releases in place for the videos submitted to Memelabs.
Video Creation Requirements
• Acceptable source Video includes sources that are not copyrighted. Contestant takes responsibility that all images and soundtracks are not copyrighted material. This means, do NOT use commercial copyrighted music or images.
• Videos may not contain obscene language or content, including but not limited to: nudity, profanity, or graphic violence.
